Applications for Variation to Part 4 of the Building Regulations, Section 29A, Building over an Easement, Hoarding (Public Protection) & Flood and Overland Drainage Report & Consents can be made through Council.

Please note: No electronic lodgement & payment of these requests is available through Council at present.

Payment for these requests can be sent to us via the mail with a cheque / money order or you can pay via any means at Council’s Civic Centre at 511 Burwood Hwy, Wantirna South - Opening hours are 8.30am, Closing hours are 5.00pm apart from Tuesday we are open until 8.00pm.

Variation to Part 4 of the Building Regulations Report & Consent
An application must be made to Council to vary any Standard within Part 4 of the Building Regulations 2006. The application is made to the Municipal Building Surveyor of Knox City Council.

The Standards are;

Section 29A Report & Consent
A Report and Consent under Section 29A of the Building Act 1993, must be issued by the Municipal Building Surveyor prior to any works that will result in the removal, alteration or addition of a building that will;

Result in a change to 50% of the building volume in a 3 year period, or
Cause alterations to the facade of a building.

“facade” means -
a) an external wall, including any verandah, balcony or balustrade or architectural feature attached to or forming part of an external wall; or
b) a part of a roof; or
c) a chimney that faces a street and at least part of which is visible from the street it faces;

“street” includes road, highway, carriageway, square and court.

Notes:
Any type of demolition or facade change building permits through Council, must also apply for a report and consent.

A separate request for report and consent to the Executive Director, Heritage Victoria, is required for an application to demolish or alter a building which is on a register established under the Heritage Act 1995.

Building over an Easement Report & Consent
Any building or structure that is built or placed over an easement will require consent from Council and any other Relevant Authority. (Water, Gas, Electricity etc)

When applying to Council for a Building over Easement Consent a copy of the Relevant Authority consent must accompany the application.

Any building or structure placed over an easement will require a Building Permit, notwithstanding any other exemption in the Regulation.

Hoarding Report & Consent (Public Protection)
Precautions must be taken before and during building work to protect the safety of the public if required by the relevant building surveyor.

The precautions must be approved by the relevant building surveyor before building work is commenced.

Before and during the carrying out of building work all excavations must be fenced or otherwise guarded against being a danger to life or property.

The report and consent must be obtained to an application for a building permit relating to the erection of precautions over the street alignment. The hoarding must be of a minimum standard as directed by Council in the consent.

Flood & Overland Drainage Report & Consent
The report and consent must be obtained to an application for a building permit if the site is on an allotment that is an area liable to flooding.

The report may specify minimum floor levels Australian Height Datum (AHD) that must be complied with and may contain special structural requirements.
