Amendment C176 - Waterford Valley Residential Aged Care Facility

What is Amendment C176?

The land affected by the amendment is 145 and 153 Bunjil Way, Knoxfield (Lots S3 & S5 on Plan of Subdivision 642759D) as indicated on the map:

Amendment C176 seeks to amend the Knox Planning Scheme to enable the consideration of a ‘Residential aged care facility’ with associated uses at the subject site. The site is currently vacant and is designated for hotel and function/conference centre uses under the current planning framework.

At its Strategic Planning Committee (SPC) meeting on 8 April 2019, Council resolved to seek Authorisation from the Minister for Planning to prepare and exhibit Amendment C176. View the Council report and minutes.

Subsequent to Council’s resolution, conditional Authorisation was received from the Department of Environment, Land, Water and Planning (DELWP), under delegation from the Minister for Planning, to prepare and exhibit the Amendment.

Specifically, the amendment proposes to:

(A) amend Schedule 1 to Clause 37.02 Comprehensive Development Zone (CDZ1) to:

  • enable the consideration of a “residential aged care facility” use
  • enable the consideration of “convenience shop” and “food and drink premises (other than hotel and tavern)” uses on the ground floor of a residential aged care facility
  • include new application requirements and development requirements for a residential aged care facility, including a height restriction of maximum six storeys
  • make other minor modifications to enable the changes

(B) Revise the Incorporated Document Waterford Valley Comprehensive Development Plan to indicate ‘Residential aged care facility’ and associated uses as a conditional use for the subject site, and update the Schedule to Clause 72.04 to reflect the revised Incorporated Document.

The exhibition period for Amendment C176 has now closed.

Please note that in accordance with the Planning & Environment Act 1987, Council must make all submissions made to Amendment C176 available for public inspection at its office for any person to inspect for a period of two months after the Amendment comes into operation or lapses.
